Quick Action: One email to our beloved, outspoken, and fearless Senator Robert Byrd (D-West Virginia) to Contest the Election on January 6th.
Why? According to the Electoral Count Act of 1887, at least ONE senator and at least ONE representative from Congress are needed to contest a presidential election prior to an inauguration. We have the representatives. We still need a senator.
Senator Boxer? While many of us, including me, have focused on Senator Barbara Boxer, I now have my doubts about her ability to rise to this occasion. I happened to see her at a function and asked if she had seen that the Contest the Vote petition directed at her was at over 11,000 (now it's over 25,000! See http://www.contestthevote.org ). She responded "Yes," but she quickly averted her eyes and moved along. Of course, that was not the forum to address this commitment, but I also noticed that she did not speak of the election that evening, nor was it mentioned in the letter she sent her constituents seeking their priorities for 2005. While we can still hold out hope that she'll see the wisdom in contesting the vote, her actions have caused me to reconsider her as our best hope.
Senator Byrd! An old time politico of my community, and a person whom I respect greatly, gave me the idea that Senator Byrd is our best hope. As she says:
"He is a defender of the Constitution and is very clear sighted about the danger to the democracy inherent in the direction the radical Bush administration is leading the United States."
Clearly, he has the track record of standing up for the convictions of his beliefs, despite political consequences. In the numerous blogs I've read on which senator we should approach to contest the election, I believe he's been overlooked or dismissed.
Let's Do It: Let's offer Senator Byrd the opportunity to do what he has done so many times in the past; let's ask him if he'll do us the honor to Contest this Election.

Dear Senator Byrd:
You have proven yourself to be a hero for our United States Constitution and for that we THANK YOU.
We are now at a pivotal moment in our history and must ask you once again to take a brave stance on our behalf:
All Senators take an oath to defend and protect the Constitution of the United States from its enemies both foreign and domestic. On January 6th your sincerity and commitment to that oath will be tested.
The evidence is overwhelming and incontrovertible that the electors from Ohio were unlawfully chosen and unlawfully seated.
Evidence is pouring in that even the incomplete remedy of a recount is being thwarted by election officials brazenly engaged in a coverup designed to destroy any possible efficacy the recount could have.
If a President can be selected in this country as a result of conduct which was wildly unlawful, then the rule of law, and with it democracy, has ceased to exist.
It is your duty not to accept the vote of the illegal electors for President or Vice President of the United States, and to accept the vote of the electors who were lawfully chosen by the voters of the State of Ohio, who are committed to voting for John F. Kerry and John Edwards as President and Vice President of the United States respectively.
Your decision to honor your duty, or not to honor it, is something for which you will have to answer not only to the people of the United States, and to your constituents, but to your own families, and your children and grandchildren and their children's children, and to your own conscience.
I implore you to do your duty in defense of democracy, and not to allow "government of the people, by the people, and for the people" to perish from the great nation which introduced it to the modern world.
